The Legislative Decree 81/08 and subsequent amendments, together with the State Regions Agreements, defines the obligations that companies must necessarily comply with in terms of health and safety in the workplace. The Document, which must be constantly updated or revised in the event of significant changes in the company production process, must be kept in the company, available to the Representative for the Safety of Workers (RLS) and the supervisory bodies in charge in the event of a check.

What is the DVR?

The DVR (Risk Assessment Document) is a prospectus within which the possible risks present in a given workplace are identified. The purpose of the document is to prevent dangerous situations for workers, through a careful analysis of the potential risks identified. Following these assessments, a precise prevention and protection plan is then drawn up and implemented which aims to eliminate or at least reduce the likelihood of events harmful to the health and safety of workers

The DVR must contain the following information:

Regardless of sector, the DVR is mandatory for all companies that have at least one employee or collaborator. It must be drawn up within 90 days for a new activity or immediately if a worker joins a company that has already started.

The manager of the DVR is always the employer, who cannot delegate this activity but can decide to rely on the advice of a technician specialized in occupational safety.

Depending on the specific cases provided for by law, the Head of the Prevention and Protection Service, the Company Doctor and the Workers' Representative may also be involved in the drafting of the Document.

The DVR must be updated whenever the company undergoes significant changes in the production process and / or organization, as well as when new machinery and / or new tasks are introduced within it. The original copy of the Document, signed by all the figures who took part in the drafting, must be kept in the company and made available in the event of inspections by the ASL, INPS, INAIL or Fire Brigade, which may ask to view it .

Failure or incomplete drafting of the Risk Assessment Document can result in heavy penalties for the employer: fines from €3,000 to €15,000, suspension of the existing activity and, in the worst case, a prison sentence of up to 8 months.
